Under the Health & Safety at Work Act 1974, it states that one of an employer’s main duties is to ensure so far as reasonably practicable, the health and safety at work of all their employees. This includes the provision of safe plant and systems of work.
The Lifting Operations & Lifting Equipment Regulations 1998 aims to reduce the risks to people’s health and safety from lifting equipment provided for use at work (such as cranes on hire on a construction site, hoist or forklift truck). The regulations require that lifting equipment is:
- Strong and stable enough for the particular use and marked to indicate safe working loads
- Positioned and installed to minimize risks
- Used safely
- Subject to on-going examination and where appropriate, inspected by competent people
In addition, the Provision and Use of Work Equipment Regulations 1998 stipulates that where work equipment is exposed to conditions causing deterioration which is liable to result in dangerous situations it must be inspected at suitable intervals by a competent person. Records of inspections must be kept with sufficient information to properly identify the equipment, its normal location, dates, faults found, action take, to whom faults were reported, who carried out the inspection.
Compliance is based on the following 3 criteria:
- It is in an efficient state
- It is in efficient working order
- It is in good repair
